TO OUR VALUED CUSTOMERS:
After more than 1 1/2 years of litigation, Visible.net, Inc. (”Visible”) announces that the Washington Attorney General is dismissing its claims against Visible with prejudice in return for a settlement that will allow Visible to get back to doing what it does best: providing exceptional products and services to its customers.
The Attorney General originally filed the lawsuit against Visible in November 2008. Although the lawsuit claimed that Visible was guilty of widespread misrepresentations, after more than a year of investigation, the Attorney General was only able to identify a single statement in one marketing script that the court determined had the potential to mislead the public. Significantly, there is no evidence that Visible ever used the specific script in question or that any Visible customers were ever misled by the statement.
Moreover, although the Attorney General argued that Visible was required to register as a commercial telephone solicitor, the court found that the Attorney General had failed to prove that Visible was required by law to register. Nevertheless, because Visible voluntarily registered as a commercial telephone solicitor on its own, the court decided that Visible was required to comply with the rules of a commercial telephone solicitor. Under the terms of the settlement reached with the Attorney General, Visible has agreed to fully comply with those rules.
Visible’s own investigation related to the litigation revealed that to a large degree the so called “consumer complaints” provoking the Attorney General investigation were actually drummed up by competitors of Visible who in some cases misrepresented to consumers that they were employed by the Attorney General’s office. The settlement reached with the Attorney General’s office paves the way for Visible to pursue these competitors for fraud, while still serving the needs of its customers. For more information about the lawsuit, or about Visible’s line of quality products and services, please contact Visible.net’s President, Glenn Jones, at (888) 820-5383 - Ext. #910 or directly at (425) 250-0910.
Warmest regards,
Gilbert Walker, Chief Technology Officer & The Visible.net Team
Original Company Response: Visible.net Is Serious About Customer Service & Support (Posted on November, 14th 2008)
We have embarked on a new year and all of us here at Visible.net are looking forward to another ground-breaking year in 2009. After having ended 2008 with snowfall, flooding, rain storms and plenty of cold weather, it will be important for us to make up for lost time before winter comes to an end.
With a new year always comes new opportunities to change, exceed and excel towards past, current and future goals. We all have the opportunity to accomplish great things this year, so lets continue to work hard towards our goals this new year.
Just as your car runs more smoothly and requires less energy to go faster and farther when the wheels are in perfect alignment, you perform better when your thoughts, feelings, emotions, goals and values are in balance.
